Hi,

I am very sad to report that I have had some seriously bad news this past two weeks. Many of you know my family and I moved into a temporary living arrangement in town here (Nashville) in July 2002. What seemed to be a good move for a short time became nightmare on Elm Hill Pike. My wife (disabled with scleraderma, fibromyalgia, and reynauds phenomenon) was showing no serious signs of her previously diagnosed illnesses when we moved in. Our baby daughter was 2 at the time, and my wifes son was 13. I had never suffered sinus, or allergy infection, and neither had the children. Many of you know that we started the PedalSteel.us Magazine, and many know that due to illness in our family, it became stopped. Here is what I didn't know until only a few weeks ago. The laundry chemicals that are produced (by cleaning all of the hotels linens, cleaning towels, and bathroom and sink towels) in the "house laundry room" located directly beneath our bedroom.... that vented outside right into (actually about a foot away from) our bedroom air unit, had serious leaks. It is a gas dryer system with three older commercial machines. And the walls that held it are loaded with Black Mold (like the man from Montana on CNN last night) and was filling our lungs every night for the past several years, without our knowledge. I have been to the emergency room myself numerous times, and our little girl has been into the ER as well. Last thursday, my wife, myself, and our daughter all went in an ambulance to ER, after already being to our doctor only two days earlier, and being told we needed to change rooms. The hotel only changed rooms for one night for us, and the following day demanded payment for all of the rooms. (We are in a two bedroom managers apartment suite, and the only other rooms that they have in the hotel are one bedroom units.) They also wanted cash again if we were intending to get another night. Needless to say, if they were full up..., but no, they were nearly empty, and didn't care that we had been requesting room change, or better air quality, and even to the point of complaining about the air quality, for over five managers, in only two years and eight months. Each time we had gotten a managers attention, and that manager began to take an honest look at our problem and address it, he would be moved (or fired) and a new manager would come into the situation (usually with a worsened attitude towards us) and we would have to start addressing the problem all over again. Everyone has asked, why didn't you move? Well, the truth is, we have a very small disability income to work off of, and unfortunately, while I and the rest of my family has remained sick continuously since we moved into Studio Plus, it has been impossible to work, or move, or anything. But, you see, when you're sick, you just want to get better. When you get a little better, you want to work (to make money to move) but, if you can't ever get over being sick all of the way, and nobody can tell you why you're sick (except that if you get older and you live in Tennessee) that you might be developing sinus allergies. Well, thay all had me thinking and believing it was true, until the man from the Health Dept. told me that I should check out this website... www.toxic-mold-news.com/
and these links:
toxic_mold/mold.html
toxic_mold/stach.html
right after he told me that I should get an Environmental Engineer to sample the air to
verify his findings. According to the Health Inspector, he suspected we have several kinds of mold (silent killers) including Black Mold. Unfortunately, the corporate manager ordered the Environmental Engineer off the property and told him he could not allow him to sample our air quality to tell us exactly what risks we were up against. Coupled with the laundry chemicals, we've been "paying to be poisened" and not even getting the peppermint on the pillow. I have lived in hotels (while working on the road in bands) most of my early life) and have never known of these kinds of potential for hazardous living conditions. I have honestly believed that I had put my family into a safe (yet very costly) environment. When we all arrived home last Thursday from the hospital (so looking forward to resting-though I first needed to go and get food and the prescriptions filled for the family) instead, I was handed a ten day notice to vacate my lease and be off the premisis. We started to move, but our daughter and my wife weren't doing so well. I put up for a room next door at another hotel, at about twice the cost per night, and continued to move some more of our belongings. (Nobody wants to come over here to help because they all get deathly ill in only a short time -15-30 minutes- and a migraine headache that lasts usually about 3-6 hours after they leave. Though I feel I am close to getting out, I am now near breaking down again. I need strength, and your prayers. An ambulance carried me to the ER once again this past morning (2/17/05) because I couldn't breathe, moving out by myself. With serious hypertension, they thought I was taking drugs, but after talking to my wife and following up on the previous ER report from another hospital, they urged me and the family to go to the Vanderbilt Medical Center Toxicology department. We are going when I get some things straightened out, both financially, and physically finished with our things being moved. This stuff has affected my motor skills, and my thinking. (And some of you all thought I was really a bastart)

I am alone against these big corporate folks. They have lied over and over, telling us that the inspectors, and fire marshal, and health inspector, all have found nothing. I have proof that there are, and in some cases were actually plenty of problems, and we were not safe at all! They have been poisoning me and my family. And yes, it probably is their fault that I was sick and could not get the magazine out to you. And now, they have thrown us out on the street, sick as dogs. Studio Plus Hotel in Nashville, an ESA property has taken over 60K+ in actual CASH MONEY from our family, and that's how they have finished us off - out on the street.
(ESA, a subsidiary of Blackstone-Smith owns Universal Motion Pictures, Enron, and the group of hotel chains called Extended Stay of America, Homestead Suites, Studio Plus and Hometown Studios, not to mention several other major corporations.) I would appreciate any help, especially your prayers, as I expect the battle will get much greater before it gets better. No income, and broke, and sick... but, at least I still have my family, and they seem to be doing somewhat better. Please find it in your heart to keep my family in yours, as we need warm hearts to hold us right now. Life has been very cold here lately. Thank you in advance, and may God bless you.

Sincerely,

Terry Wendt

I am troubled by the illness of you and your family and wish you all a speedy recovery. I would suggest you study other references than those who seek legal remedy for your health problems. Such as, ; Or I am sure that the steel guitar community will patiently await your recovery and the future publication of the Pedal Steel.us.

Terry I met you last Sept. at Legend's Corner and had a great time.

I am VERY troubled about your situation, and also having been sick myself for several months, since I got a flu in Nashville and it lodged in an ear on the lfught back,
I can FULLY understand the debilitating effects of long term illnesses. And the idsoprentation and effetcts on anormally rational mind

quote:
Unfortunately, the corporate manager ordered the Environmental Engineer off the property and told him he could not allow him to sample our air quality to tell us exactly what risks we were up against.

It would appear this company knows about the problem, and is running scared on the local level, and up above they are being told just quash it.

Molds and chemical fumes are ABSOLUTELY deadly.

I think the only reason they didn't move you, was THAT would have admited that they had been culpable for long term health violation's.
So therefoer giving to you good amunition to sue.

With your wifes health issues and the little daughter, it would have been VERY sympathetically seen by a jury.

Which means BIG damages... the coprorate attornies no doubt saw that.

You certainly get a pray from this quarter.
and those corporate b----d's can roast in hell soonest possible,
they certainly will eventually.

Terry, it's with great sadness that I read of your plight. A few questions arise, is housing so bad in Nashville that it's cheaper to live in a hotel/motel? Have you consulted Social and family services about your problem as it seems that you don't have a family support to take care of you? Also, it could be a blessing in disguise that they evicted you as you're now out of that environment. You'll probably notice a strong change in you family's health in a new place, if not your finances. I wish you all the best and hope your fortunes get much better. This should postpone some grief about the magazine and give you some time and health to deal with that albatross around your neck. Good luck, buddy.

Thanks for the support. Everyone seems to be feeling better except me, but I still have a bit of stuff to remove from the place, and a bunch of crud in my breathing and nasal passages. Sore throat comes along with nausea, vomitimg, diarhea, migraine, and that's just a little bit of the crap. We do all have some strange markings (like bruisings without a cause for the bruisings, and some red bloody dotted spots) appearing on our body, cannot urinate properly, and Sharon is having some stomach issues. I still have to move some more stuff and can't seem to find a mask here in Nashville that blocks both the myotoxins and mold spores. ...and Yes, there is a reason we had to move into a hotel. It wasn't any grandios idea, or a big ego as some would want to think. To begin with, we had no furniture. We had sold our furniture to earn money to make the move in the first place. The hotel boasted of "Corporate Suites" for relocation of business ( http://www.studioplus.com/about/main.asp ). We had our printing company business, and they claimed they had everything necessary to relocate temporarily, whether for a week, months, or even a year or longer. This was in the same school that our son (in High School) was presently attending, and very near all of the things we were already near to our home in Hermitage. Seemed like moving right down the street in many ways. We only moved here because we had very little choice. When we were living at my brothers house in Hermitage, we had remodeled much for him there to earn the deposit, without giving actual monies. We had been awaiting my wife's final divorce settlement for two and one half years, and received a letter from the court in Louisiana stating that the Final Hearing Date was finally set in July, so we figured with the thousands of dollars on the docket coming our way, a temporary hotel was the responsible choice. The case was then postponed indefinately. I am not complaining, but explaining. It's hard to judge the situation when you have only partial facts. I appreciate your prayers, all of them. That's what I requested... and thank you for them. I doubt I will get to read anything else up here today, as I am going to have to go back to the doctor, then attempt to get a few immediate issues worked out. Additionally, when the hotel people started receiving faxes from our realtor and mortgage broker, they turned up the heat/punishment on us. I'm not sure, but I believe David D was correct, they didn't want us to get better (and yes, I am blessed that we are out of there, for the most part, and now we can heal hopefully) as now we can put our finger directly on the cause... sort of. Although the mold/toxin/chemical cocktail has me more than a little concerned about the long term affects.

One more new bit of info... the manager I originally met, who rented his managers apartment to us in July 2002 stopped over at the hotel we are now staying at next door. He quit about three months after we moved in, so he could go to manage the Gibson Showcase Music Store at Opry Mills, and his name is Keary Jordan. He said that as soon as he and his family moved out of the same apartment we were living in, their sinus troubles and bronchial troubles eventually cleared up. The only real difference was that the black mold was not prevelant then to add to the laundry chemical toxins, and his wife didn't suffer an auto-immune disease, and he didn't have an infant/toddler living in that situation for nearly three years. Again, that is why I am asking for your prayers. For those who care not to pray for us, God Bless you anyway, and for the rest, thank you so very much, as I do believe and know that prayers make the biggest difference of anything.

Sincerely,
Terry (and family)

Terry, This story is downright awful. It only takes one thing in this life to destroy an individual or family. I want to put your family on my prayer list and hope everything turns around for you and your family. It is sad to see a manager try to do something and be fired. It is all about money and what it will cost to repair if it can be repaired. Sometimes the system stinks and this situation is one of them. Best wishes to you and your family and I pray your health is not ruined due to this mess.

You have our prayers as well. I think it's time to take it a little further, if you can.

That would be Praise the Lord and pass the ammunition. The laywer is the next step if that is possible. Time to lay down the heavies on this place and get it cleaned up or totally shut down.

As bad as it was for you, someone else who will live there may have it worse. Perhaps it is you who have been chosen by God to put an end to it thru the legal process. Go for it, if it feels right after considering it. You know where the strength to do it will come from. It's already there, waiting for you to reach up and take it.

Hi Terry, we're pullin for ya here in SC. If you can get by a hospital drop by the ER and explain your situation and ask if they can give you some orange duckbill masks. They use these in the hospitals I work in where there are TB patients, in some cases, it depends on the caretaker. I have seen them use these in place of NIOSH approved respirators. So I would think this would be sufficient to help you get your stuff moved. If you can't get any there, shoot me your address and I'll grab some at work tomorrow. BTW, do you know what specific type of mask you need? I can check and see if we have those too.

Take Care

Hi David, I would much appreciate the masks. I have everything now in storage, but have to handle everything (each item individually) to clean it, and now everything I had in the storage is possibly affected. PO Box 290217, Nashville, TN 37229-0217.
I so much appreciate the prayers. I have praised God from the gitgo! The problem Sharon and I are having is, Bobbe was just joking, and doesn't know anyTOXIC/BLACK MOLD ATTY. And, we are told that nobody has any power... from EPA to local HEALTH DEPT, etc...................... and on and on. We have to be close, but we can't figure out who actually takes care of this in this God forsaken county of Davidson, Nashville Metro, TN. It has been very tough on all of us in every way. Forgive us dear God, and thanks for getting us out of there.

Again, thank you for your prayers, all of you and for all of them.

Terry, I too feel for you and your family in this situation. Sometimes, if you can get the news media involved, they can bring this type of problem to the attention of someone that can help. Most newspapers and TV stations have a "Troubleshooter" that can work on your behalf.

Any attorney who specializes in liability cases such as this could help you. Some/most or all would probably take it on a contingency basis if this is in fact what has happened and can be proven. All you have to do is pick up the yellow pages and select an attorney and make a phone call. The first call is free and they will tell you if they can help you or not. This is not rocket science!

I think Jerry's suggestion is an excellent one, Terry. You know the old cliché, "If it bleeds, it leads!" This one is a bleeder for certain - and I'd bet they'd try to make things right with you and your family. Since the humanitarian response doesn't seem to be there, maybe the threat of exposure will get some action.

I want to thank everyone for their prayers and wishes. I also want to give thanks to God for seeing us through another day. We are no longer breathing the source of the spores, but I have had to go back to the unit a few more times. My family is still having some trouble with health over those BLACK and GREENISH BLACK MOLD spores growing in the unit. I have several dozen pictures, and below are four. This should give you an idea of what it is we have been living in. As for the attorney, I am concerned foremost with my family and their welfare. If one comes knocking, good for us. (They charge for that occupation here in Nashville, and it's like trying to find a steel guitar player in the sticks, and having to settle for an accordian player. The don't have the same affect when it counts the most.) I believe when it is the right time the news media will find out about our situation. I was contacted by a motion picture company yesterday in CA. I think we need someone locally, that knows someone else locally, to inform them of the scoop. I am too busy at present trying to find the next... well you must know.

Here is the laundry vent (freshly patched) that passes directly under the headboard of our bed (located exactly where the patch in the dryer vent exhaust pipe is):

Here is the carpet flooring above the leak and over a bit nearer the wall HVAC unit in our apartment unit, right where the ductwork exits the outside of the building:

Here is the vent that takes in the ??fresh??? air in our bedroom window (about two feet from our dryer vent exhaust), also located directly above the carpet mold on the floor by our bed:

If we want any air to keep the heat off our room, we were using a fan offered by the hotel to put into the window in our sons bedroom. We could then draw the natural gas fumes off of the soffit ventilation, mixed with the BLACK MOLD growing in the wall where the roof was leaking. I complained about it numerous times, but the management and the maintenence man thought repeatedly that it was the HVAC leaking. Oh Well, now the BLACK MOLD has been there for some time, and we have been drinking it with the laundry chemicals all night:

It still has us hoping we all heal, and not continue feeling as we have for a long while. I pray God has mercy on the world. Thanks again everyone for your prayers. They are keeping us alive, literally.

Sincerely,
Terry Wendt

Thanks again folks for the prayers. I cannot tell you how much we can still use them either. The pressure is getting more intense, and we are still praying for an atty to take our case. The property has brought suit against us now, of all things. It is a ripshod law system we have in Nashville, and the bad guys can win by being dirty, if they throw a good first punch. (Even way below the belt is acceptable.) Please continue to keep us in your prayers.

The fact that they could even consider a suit against you shows you
a.) the low caliber of these people
b.) How scared someone is to think a premptive strike is warrented..

Discredit you and tie up you very limited funds, so that both can't be used against them...

Thanks David,

That's exactly what I believe is happening. When I (out of curiosity) asked today, "what will it take to settle this?" I was told, basically, that I had to drop my thoughts about (and agree in writing that I, or anyone from my family, will never) bring a counter suit against them. Kinda smells like a smoking gun? We aren't even well yet
